In short: Tell us everything that matters about your event in advance โ venue, ages, allergies, restrictions, electricity and access. We'll bring the magic and run it safely. A few effects (bubbles, fog, confetti, glow) need the right conditions, so please read Section 5. The adult booking us is responsible for the venue and for supervising the children during the event.
1. About these terms
These Terms & Conditions govern all entertainment services provided by Animator Malta ("we", "us", "our"), to the person or organisation making the booking ("you", "the client"). By confirming a booking โ in writing, by form, by message, or by paying a deposit โ you confirm that you have read, understood and agreed to these terms.
2. Bookings & confirmation
- An enquiry, quote or held date is not a confirmed booking. A booking is confirmed only once we agree the details with you and the required deposit/payment is received.
- Certain requests cannot be self-booked on the website and must be arranged with us directly โ for example: two or more shows combined, groups over 30 children, events on Gozo, custom costumes/themes, extra equipment, extended duration, multi-session bookings, hotel/B2B and adult events, children under 4 or with special needs, and venues without electricity.
- It is your responsibility to give us accurate event details. We are not liable for problems caused by incorrect or missing information.
- Attendance: the fee is for the booked show and is not reduced if fewer children attend than expected. The show proceeds regardless of the number of children present.
3. Prices, payment & deposit
- Prices shown are per single show, performed in Malta, and are quoted excluding VAT unless stated otherwise. VAT is added at the applicable rate. All prices are in euro (โฌ).
- Travel: travel within Malta is included. Gozo is charged at +โฌ150.
- Combined shows, large groups, and custom requirements are quoted individually.
- Deposit: we usually do not require a deposit. For some bookings we may ask for a small deposit (โฌ50 for a standard event), which secures your date and is deducted from the total. If a deposit is taken, it is non-refundable, as it covers a slot we hold for you and turn down for others.
- Payment: we don't take prepayment โ the full amount (or the remaining balance, if a deposit was agreed) is due after the event. We may ask for proof of payment.
- Prices quoted are valid for the period stated in the quote and may change for new bookings.
- Obvious errors: if a price is displayed with an obvious error, we are not obliged to honour it and will let you know before confirming your booking.
4. Cancellations, rescheduling & your right to cancel an online booking
- By you: we take no deposit, so cancelling early costs you nothing. Cancel 7 days or more before the event and there is no charge. Cancel less than 7 days before and 50% of the agreed fee is payable. Cancel less than 48 hours before โ or the event does not go ahead on the day for a reason on your side โ and the full fee is payable.
- Rescheduling: we'll always try to move your date subject to availability, at no extra cost if you ask 7 days or more in advance. Requests made within 7 days of the event may not be possible; if we cannot offer a new date, the cancellation terms above apply.
- By us: in the rare event we cannot attend (for example illness or circumstances beyond our control โ see Section 9), we will offer a suitable replacement performer where possible, or reschedule, or refund amounts paid for the cancelled service. This is the limit of our responsibility.
- Late access / overrun: the show runs for its booked duration. If we cannot start on time because of delays at the venue or with the client, the finish time is not extended and no refund is due for lost time.
- Wrong details: if we travel to an incorrect address, or cannot deliver the show because of wrong or missing details you provided, no refund is due.
- Setup: our team typically arrives around 30 minutes before the start to set up. Please allow access for this.
Right of withdrawal (consumers). Under EU/Maltese consumer law you normally have 14 days to cancel a contract concluded at a distance (e.g. online). However, this right does not apply to contracts for leisure or entertainment services provided on a specific date or period (Consumer Rights Directive, Art. 16). Because our shows are booked for a specific date, the 14-day right of withdrawal does not apply, and the cancellation terms above apply instead.
5. Special effects, safety & what you must tell us
Some of our shows use special effects. These are safe when the right conditions are met, but you must tell us in advance about any relevant medical conditions, venue rules or restrictions so we can adapt or remove an effect. We are not responsible for reactions, alarms, damage or venue issues caused by effects you did not ask us to exclude in advance.
- Bubbles & bubble fluid: bubble shows can leave floors and surfaces slippery and may mark clothing or furnishings. You must provide a suitable area and supervise to prevent slips. We are not liable for slips, stains or damage where a safe space was not provided. Tell us in advance of any known sensitivity to bubble solution; avoid eye contact and do not let children drink it.
- Smoke / fog / haze effects: may affect people with asthma, allergies or respiratory conditions and may trigger smoke detectors or fire alarms. You must inform us beforehand of any such conditions or alarm/venue restrictions so we can adjust or skip the effect.
- Confetti & paper effects: create mess that requires clean-up, and some venues prohibit them. Please confirm your venue allows them; clean-up beyond normal is your responsibility unless agreed.
- Glow / UV / neon lighting: uses bright and UV lighting; tell us in advance if any guest is sensitive to light or has a photosensitive condition.
- Balloons, props & small parts: some props or giveaways may contain latex or small parts. Tell us of any latex allergy, and supervise younger children around small items.
- Outdoor shows: depend on weather. Strong wind, rain or extreme heat can prevent bubbles and other effects from working and may require moving indoors, adapting, or rescheduling. We are not liable for weather affecting outdoor effects.
6. Your responsibilities (the venue & the event)
- Provide a safe, suitable and clean space large enough for the chosen show, plus access to mains electricity where required.
- Provide a nearby unloading spot, parking and easy access to the performance area. Any paid parking or access fees at the venue are your responsibility.
- Inform us in advance of any allergies, medical conditions or special needs of attending children, and of any venue rules (alarms, restrictions on effects, noise, time limits).
- Obtain any permissions required from the venue (for example for effects, music or noise levels).
- Give us the correct number and ages of children. For groups over 30 (and especially over 50) additional arrangements apply, and for larger groups the music/sound system is arranged by the client; we cannot guarantee every child will hear clearly in very large or noisy spaces.
- Supervision: our role is to entertain. Parents, guardians or the organising adult remain responsible for the supervision, behaviour and safety of children at all times during the event.
- Unsafe or unsuitable venue: if we cannot safely start, or have to stop or shorten a show because the venue is unsafe or unsuitable (for example no secure space, too close to a road or water, or no working power), the show is treated as delivered and no refund is due.
- Keep children clear of our equipment during setup and pack-down, and make sure props are used safely under adult supervision.
- We are not responsible for guests' personal belongings brought to the event.
7. Damage & indemnity
You are responsible for any loss of or damage to our props, costumes or equipment caused by you, your guests or attendees during the event (beyond fair wear and tear), and agree to reimburse us for repair or replacement. You agree to indemnify us against claims, costs or losses arising from your breach of these terms, your failure to provide a safe venue or accurate information, or the acts of your guests.
8. Liability
- We perform our services with reasonable care and skill.
- We are not liable for injury, loss or damage arising from: failure to provide a safe/suitable venue; failure to disclose relevant medical conditions or venue restrictions; misuse of props or equipment by guests; the behaviour of children or guests; or circumstances beyond our reasonable control.
- We are not liable for indirect or consequential losses.
- Nothing in these terms limits liability that cannot be limited by law (such as liability for death or personal injury caused by our negligence).
- Where our liability is not excluded, our total liability for any booking is limited to the total amount paid for that booking.
9. Circumstances beyond our control (force majeure)
We are not liable for failure or delay caused by events beyond our reasonable control, including illness, accident, transport failure, extreme weather, power failure, public health measures, or venue closure. In such cases we will offer a replacement performer, a new date, or a refund of amounts paid for the affected service, at our discretion.
10. Photography & media
We may take photos and video at events for our portfolio and social media. If you do not want images of your event or your children used, simply tell us in writing before the event and we will respect that. You confirm that, where you book on behalf of others, you have the authority to agree to this. If you or your guests take photos or video at the event, it is your responsibility to obtain consent from the people appearing in them.
11. Intellectual property
The format, characters, scripts, choreography, music selections and creative content of our shows remain our property or that of our licensors. You may take personal photos and video of your own event, but you may not record, reproduce or use our shows for commercial purposes without our written permission.
12. Equipment & performers
All props, costumes and equipment remain our property. We reserve the right to substitute a performer, prop or element of equal standard where necessary without reducing the quality of the show. Age recommendations for shows are guidance to help you choose; the final choice is yours.
13. Behaviour & right to stop a show
For everyone's safety, we may pause or stop a performance if there is threatening, abusive or unsafe behaviour, or conditions that put our team or guests at risk. We may also decline to start, or stop a show, if guests appear unwell, intoxicated or under the influence of drugs, or if alcohol or unsafe behaviour around the performer puts anyone at risk. In such cases no refund is due.
14. Complaints
We want every event to go perfectly. If something isn't right, please tell us as soon as possible โ ideally during or immediately after the event, and in any case within 48 hours โ so we have a fair chance to put it right. 15. General
- Entire agreement: these terms, together with your booking confirmation, form the whole agreement between us.
- Variation: we may update these terms from time to time; the version in force at the time of your booking applies to that booking.
- Severability: if any part of these terms is found invalid, the rest remains in force.
- No waiver: if we don't enforce a term on one occasion, it doesn't mean we waive it.
- Assignment: you may not transfer your booking to a third party without our agreement.
- Third parties: no one other than you and us has any rights under these terms.
16. Governing law
These terms are governed by the laws of Malta, and any disputes are subject to the jurisdiction of the Maltese courts.
